DOJ wants better collaboration between the police and the fiscal system

The prosecution service will undergo additional changes in the coming days, according to Justice Secretary Jesus Crispin Remulla, who also announced measures to strengthen collaboration during the case-building phase to achieve strong indictments.

“An example of a case build-up rule is, “Ang prosecutor and the pulis are sabay na silang magtatrabaho.”

We are also working on a case buildup rule that we are finalizing where prosecutors and police will work side by side. Yan ang mahalaga na bawat โ€” halimbawa may nahuli ang pulis, idedemanda na niya, kailangan makikipag-usap siya sa prosecutor para lahat ng ebidensyang kinakailangang makalap upang ma It is crucial that a police officer work with the district attorney to obtain all the necessary evidence before pressing charges after detaining a suspect “Remulla declared.

He stated the initiatives are aimed at increasing the success rate of prosecution.

“Kaya nga itong antas ng pagtingin sa probable cause at sa reasonable certainty of conviction, yan ang aming nilalagay ngayon upang mas malakas ang pag-asa na ang prosecution ay maging epektibo na kapag dumating ang panahon na ang tao ay din

On Tuesday, Remulla met with representatives of the Supreme Court to talk about potential changes to the legal system.

The Department of Justice (DOJ) published new rules for prosecutors on Monday, lowering the suggested bond in criminal cases for short-term freedom for the needy to PHP10,000.

In accordance with Department Circular O11, the prosecution may only set the bond at PHP10,000 or 50% of the recommended bail amount as mentioned in the 2018 Bail Bond Guidance in cases involving poor defendants.

The DOJ claimed that the action and Department Circular 008-A’s prior directive to limit criminal cases to those with solid evidence supporting them would “decongest court dockets.”

The new rule is applicable to every case involving an inquest or preliminary examination of an indigent person, provided that the crime is not one that is punishable by death, reclusion in perpetuity, or life in prison.

The lower bail is intended to keep people out of jail who can actually post bail but cannot afford the sum set by the court.

The policy was introduced due to last month’s Justice Sector Coordinating Council (JSCC) discourse, which covered topics such as the overcrowding and overuse of jail and detention facilities.

Several of the issues the Bureau of Prisons is currently dealing with, like corruption, drug smuggling, and inmate entitlement, were brought on by the 330 percent congestion rate in the New Bilibid Prison in Muntinlupa.
