Guanzon denies delaying the delivery of the Marcos DQ judgement
On Wednesday, a Commission on Elections (Comelec) official dismissed charges that the agency is delaying the decision of disqualification cases against presidential candidate Ferdinand “Bongbong” Marcos Jr. in order to favor one party.
In a Facebook live video, First Division Presiding Commissioner Rowena Guanzon said, “It is not true to claim that we are delaying in order to favor one party.”
At the same time, she pointed out that the cases filed against the former senator in the First and Second Divisions are based on separate reasons.
“The main question in the case filed in the second division is whether Marcos Jr. made a false statement or made a false material representation. “The cases we’re dealing with are disqualification cases,” she explained. “The cancellation of the certificate of candidacy has many causes, and they have various disqualification grounds according to the legislation.”
Guanzon stated that if the respondent is disqualified, he can be replaced.
“He can be replaced as long as the replacement is from the same party and has the same last name as him. They don’t have to be related if they share the same last name and political affiliation. She went on to say, “The cancellation of COC, no substitution, in disqualification there is substitution by noon on May 9, 2022, provided they belong to the same political party and surname.”
Guanzon, on the other hand, stated that the division’s decisions can still be appealed to the Commission en banc.
Guanzon had stated that the decision on the disqualification charges brought by Bonifacio Ilagan and others, the Akbayan party, and Abubakar Mangelen will be issued by the middle of January.
However, Comelec Education and Information Department chief Elaiza David said on Monday that the text of the judgement is still being prepared since certain staff members of one of the commissioners handling the issue have gotten coronavirus.
The Second Division of the poll board refused a plea made by Fr. Christian Buenafe, among others, to revoke Marcos’ COC for lack of merit on Monday.
