The government formalizes anti-scam procedures against real estate con artists.

The government has formalized its aggressive campaign and enforcement measures against unlawful operations involving real estate and other housing developments in the country.

Over the weekend, Secretary Eduardo Del Rosario of the Department of Human Settlements and Urban Development (DHSUD) signed a memorandum of agreement with representatives of the Real Estate Brokers Association of the Philippines to formalize their partnership for a nationwide crackdown on real estate scammers.

The action is part of the Department of Housing and Urban Development’s Special Order No. 2021-002, which establishes a technical working group (TWG) to institutionalize the department’s increased anti-illegal real estate activities efforts.

The Department of Housing and Urban Development, in collaboration with the Department of the Interior and Local Government, as well as other national government and law enforcement agencies and REBAP, will take a whole-government approach to illegal transactions and other issues in the housing industry.

Del Rosario underlined the need of working together to stop illegal activities that target homebuyers.

“Its national clout is crucial to uncovering real estate scammers,” the housing czar said, thanking the REBAP for its effort to advancing this fight.

“I’d like to thank REBAP for their assistance in our campaign to pursue unlawful real estate groups that prey on our homebuyers; with your cooperation, we can reinforce our force to pursue them and ensure that less and fewer homebuyers fall prey to their schemes,” he added.

REBAP’s assistance, according to Del Rosario, “would undoubtedly improve” the department’s effort against illegal housing practices.

“To put an end to this crime, we will continue to cooperate with relevant parties in the human settlements and urban development sector,” he said.

The REBAP network of broker-members will function as “monitors” of illicit actions under the newly inked accord, and will be responsible with submitting documentation evidence to the TWG.

The association is in charge of investigating unlicensed/unaccredited/unregistered people’ sales, leasing, joint ventures, and other similar activities.

The monitoring team should look for and document violations, as well as gather evidence including media coverage, defective flyers, and victim statements.

It will be followed by the submission of a narrative report of the violation committed under Presidential Decree 957, also known as the Subdivision and Condominium Buyers Protective Decree, and Republic Act 9646, also known as the Real Estate Service Act, as well as other real estate-related legislation.

After that, the findings and paperwork will be sent to REBAP’s national office for review. Cases with sufficient merit will be sent to the Department of Homeland Security and Urban Development (DHSUD) for coordination of legal processes and apprehension through authorized agencies.

The DHSUD urged the public once again to be wary of phony brokers who are involved in unlawful real estate deals.

According to Presidential Decree 957, no real estate broker or salesman shall operate in the business of selling subdivision lots or condominium units unless they are registered with the Housing and Land Use Regulatory Board (HLURB).

The DHSUD has regulatory authority over real estate developers, brokers, and salespeople, who must register with the DHSUD before selling property.
