The CSC has the authority to reprimand government employees: SC

MANILA – The Supreme Court (SC) affirmed a former accountant of the National Statistics Office-Bicol (NSO-5discharge )’s from government service for significant wrongdoing in a bidding process.

Milagros Longasa filed an appeal, disputing the decision of the Civil Service Commission (CSC) and the Court of Appeals (CA) to dismiss her, which was dismissed by the SC Second Division on May 6.

Longasa, who was then the head of the agency’s Bids and Awards Committee, assisted all transactions linked to the move of an NSO regional office in July 2007 because the prior office was frequently flooded, destroying papers and other information.

Longasa was found accountable by the CSC for allocating 25 square meters to her canteen company, which was part of a 300-square-meter property leased by NSO-Legazpi City.

The supplies needed to build Longasa’s canteen were also included in NSO’s purchase.

A letter complaint was sent to the Commission on Audit (COA) in 2008, sparking an investigation that resulted in a CSC decision dated Dec. 30, 2010, finding Longasa guilty of grave misconduct and ordering her expulsion from the service.

She disposed of NSO’s unusable properties without public bidding, according to the COA investigation.

The Supreme Court, in dismissing her appeal, emphasized that the Constitution gives the CSC the authority to reprimand government officials and employees.

“It is a basic doctrine that the findings of fact of quasi-judicial authorities, such as the CSC, are given substantial weight in assessing the pieces of evidence placed before them,” the court concluded.
