
Candidates for the BSKE in 2023 are invited to familiarise themselves with the campaigning guidelines.
On Tuesday, the senior regional election official reminded candidates for the Barangay and Sangguniang Kabataan Elections (BSKE) on October 30 to become familiar with the regulations governing campaigning.
The Central Visayas regional director of the Commission on Elections (Comelec), lawyer Lionel Marco Castillano, claimed that BSKE laws differ from regular local and national elections, particularly about campaigning.
Castillano stated that the election period for the village polls would begin on August 28 with the beginning of the certificate of candidature (COC) filing and end on September 2.
He stated that from September 3 through October 18 candidates will not be permitted to hold any campaign-related events or activities on the day following the COC’s final filing deadline.
From October 19 through October 28, there will be a 10-day promotion.
According to Castillano, the Supreme Court’s ruling in Penera v. Comelec, which found that premature campaigning is illegal, does not apply to manual elections (like the BSKE). Hence the candidates are not permitted to campaign from September 3 until October 18.
Castillano emphasized that candidates for the BSKE “may only be considered candidates at the beginning of the campaign season.
Even though no one has ever been found guilty of buying votes, he added, the election authority takes charges against anyone found selling or buying votes seriously.
According to him, voters should work with law enforcement agencies from the time of the arrest through the prosecution and conviction process to assist the Comelec in punishing vote-sellers and buyers.
To avoid sanctions should they fail to do so or are discovered to have overspent during the elections, candidates need also file their statements of contributions and expenditures (SOCE), according to the candidate.
“Be very cautious when you overspend. The deadline for SOCE filings will be on November 29—30 days after the elections, according to Castillano.
He said that the law requires all candidates, including those running for SK, to submit their SOCE.
Candidates for the BSKE are limited by law to spending PHP5 on each voter.
