The Department of Justice says a new law permits hotels to keep quarantined visitors from leaving.

Hotels and other establishments may refuse to let guests out if they have not completed the government-mandated quarantine period.

Justice Secretary Menardo Guevarra, speaking with President Rodrigo R. Duterte at his Talk to the People on Tuesday night, highlighted that under current law, quarantine institutions that fail to ensure that quarantined individuals adhere to the required period may be held accountable.

The Mandatory Reporting of Notifiable Diseases and Health Events of Public Health Concern Act, according to Guevarra, provides relevant requirements on non-compliant companies.

“Mr. President, there is a provision in there about non-cooperation as part of forbidden conduct. Non-cooperation on the part of certain entities charged with a duty to respond to the epidemic, it seemed to me, may also be criminal. So, Mr. President, these businesses could include establishments charged with a duty, such as a quarantined hotel, to ensure that those confined within the establishment do not have the ability to circumvent quarantine requirements “Guevarra explained.

Guevarra’s comments came after Duterte stated police officers should take up the responsibility of ensuring people complete their obligatory quarantine time because hotel owners’ delegated power is “lacking.”

“(B)ecause there is apparently staff in the hotel who manage the hotel’s admission and leave. And, Mr. President, if the hotel has been recognized as a quarantined hotel, all of the hotel’s inhabitants are likely under quarantine. So, if they can’t come up with a valid cause to leave, such as seeing a doctor or going to the hospital for medical reasons, the hotel staff may be able to prevent them from leaving “Guevarra explained.

Gwyneth Chua, a returning Filipino from the United States, left her quarantine hotel ahead of the statutory quarantine period to meet with friends, which sparked the controversy. Chua and a few of her close friends were later diagnosed with coronavirus.

The Department of Tourism (DOT) announced on Wednesday that the Berjaya Makati Hotel’s accreditation has been suspended and its authorization as a multiple-use hotel has been canceled due to the hotel’s failure to prevent Chua from breaking quarantine laws.

Berjaya Makati Hotel was also fined the equivalent of twice the most expensive room’s rack rate.
