The bill on SIM registration is being hailed as a “new weapon” against cyber crooks.
The proposed Subscriber Identity Module (SIM) Card Registration Act, according to Deputy Speaker Wes Gatchalian, might enable law enforcement authorities in tracking down criminals who use mobile phones with SIM cards to engage in criminal activity.
After Congress ratified the report on House Bill 5793 and Senate Bill 2395, dubbed “An Act Eradicating Mobile Phone, Internet, Or Electronic Communication-Aided Criminal Activities, Mandating For This Purpose Ownership Registration Of All SIM Cards For Electronic Devices And Social Media Accounts,” Gatchalian made the statement.
The bill is currently pending the signature of President Rodrigo Duterte.
To prevent the spread of SIM cards, internet, or electronic communication-aided crimes, all public telecommunication organizations (PTEs) shall require the registration of SIM cards as a pre-requisite to the sale and activation of the subscription, according to Gatchalian, a major author of the law.
Terrorism, text scams, unwanted, indecent, or obscene messages, bank fraud, libel, anonymous online defamation, trolling, hate speech, and the dissemination of digital disinformation or fake news are examples of these evil acts.
“In fact, we are grateful for the current leadership’s stated support in carrying out its legal duty to ratify this historic measure, considering the critical significance of information and contemporary communications technology at this time,” Gatchalian added.
All existing SIM card subscribers with active services must register with their respective PTEs within 180 days of the proposal taking effect, according to the bill.
On a legitimate written request to the Department of Information and Communications Technology, a period of no more than 120 days may be granted (DICT).
If the subscriber fails to register, the PTE has the authority to deactivate or retire the SIM card number. It is also the owner’s responsibility to notify the SIM card’s loss or any changes in the information after registration.
“We switch SIM cards as frequently as we switch filthy clothing.” This seemingly limitless supply has, unfortunately, become a magnet for illicit and unlawful activity. “By requiring SIM card registration, we promote responsibility in their use and give law enforcement agencies a tool to solve crimes involving their use,” Gatchalian explained.
He claims that the telcos, as well as couriers and delivery riders, are all in favor of making SIM card registration mandatory.
End-users and third-party resellers will not be charged for the registration necessary under the measure.
Gatchalian emphasized that all information obtained in connection with the registration will be safeguarded in accordance with the Data Privacy Act of 2012, and any breach or unauthorized disclosure of information will be subject to the bill’s sanctions.
The National Telecommunications Commission, in collaboration with PTEs, social media providers, the Department of Trade and Industry, DICT, and the National Privacy Commission, will develop the necessary guidelines for the proper implementation of the real-name registration program, based on the parameters established by the measure.
