For the government to invest in a nuclear power plant, a legal framework is required.

MANILA – Undersecretary of the Department of Energy (DOE) Gerardo Erguiza Jr. said the Electric Power Industry Reform Act (EPIRA) needs to be amended to allow the government to invest in nuclear power facilities.

This comes as the new administration has shown interest in including a nuclear power plant in the country’s energy mix.

“At this time, the government does not have the capability to build a conventional nuclear power plant because the National Power Corporation does not have a mandate on this,” Erguiza stated during the Laging Handa public briefing on Wednesday.

The government was unable to enter the power generation business due to the EPIRA’s privatization of the electricity sector.

“However, we can work together in the development or implementation of regulatory frameworks, and we may alter our laws to include the government among those who can fund a nuclear power plant,” he continued.

According to Erguiza, research conducted by the Korean Hydro Nuclear Power Company and ROSATOM of Russia has revealed that the Bataan Nuclear Power Plant (BNPP) can still be restored.

The BNPP will require an investment of between USD3 billion and USD4 billion, according to ROSATOM.

Presumptive President Ferdinand “Bongbong” Marcos Jr. previously stated that reviving the BNPP as a source of clean and affordable electricity is part of his energy plan.

On the other side, Erguiza stated that the government can invest in electricity generation in missionary areas that are not connected to the grid by utilizing tiny modular reactors, the most recent nuclear energy technology.
