No longer required to keep PACC: Palace

Since the PACC’s investigation powers conflict with the Marcos administration’s efforts to simplify the bureaucracy, Malacanang stated on Friday that it is not necessary to keep it in place.

The PACC has been eliminated, according to press secretary Beatrix Rose “Trixie” Cruz-Angeles, since it “is not in line with streamlining.”

According to Cruz-Angeles, a complainant can submit a matter for investigation directly to the Office of the Ombudsman.

She continued, “In other words, there is no longer a need for a PACC because there are existing government entities that deal with this.

The PACC, which was established by Executive Order 43, which former President Rodrigo Duterte signed on October 4, 2017, is the principal organization tasked with eradicating all types of corruption in the executive branch.

The PACC conducts investigations and compiles evidence against public officials who are allegedly corrupt in close collaboration with several governmental and law enforcement organizations for referral to the Ombudsman.

Additionally, it has the power to carry out background checks and fact-finding inquiries on public servants who are allegedly engaged in corrupt practices.

Executive Order (EO) 1, which was enacted on June 30 by President Ferdinand “Bongbong” Marcos Jr., abolished a number of executive branch offices, including the PACC.

To achieve “simplicity, economy, and efficiency” in the bureaucracy, EO 1 eliminated the PACC and the Office of the Cabinet Secretary.

According to the EO, the Office of the Deputy Executive Secretary for Legal Affairs will now have control over the PACC’s mandate, authority, and responsibilities.

The PACC’s existing rules of procedure in administrative cases shall continue in effect unless otherwise repealed or modified, and the Deputy Executive Secretary for Legal Affairs is mandated to create rules of procedure in administrative cases falling under its purview.

The Executive Secretary will oversee the closure of the PACC’s operations and the disposition of its operations, positions, employees, assets, and liabilities.

If relevant, all personnel impacted by the PACC’s repeal may be permitted to take advantage of the benefits offered by current legislation.
