An application for a temporary restraining order (TRO) by a telecoms business to prevent the government from enforcing it’s cease and desist order (CDO) against the company after the latter’s legislative franchise expired was denied by the Quezon City regional trial court (RTC).

Judge Kathleen Rosario D. Dela Cruz-Espinosa of QC RTC Branch 91 dismissed the application by NOW Cable Inc. for the issuance of a TRO against the National Telecommunications Commission (NTC).

The government agency that issued the CDO against the business after its franchise expired last year and its renewal was still pending in Congress, the court said that the company failed to demonstrate its right to a reprieve.

The court also ruled that the case could go forward with a pre-trial conference scheduled for October 11.

According to the court, the former GHT Network Inc. company “could not be deemed to have been able to substantiate its…clear and unequivocal right to be protected by the writ it is looking for.”

When NOW Cable’s congressional franchise for its “free” TV operations ended in 2021 and was up for renewal in Congress, the NTC issued a CDO.

However, the corporation insists it is permitted to carry on with its cable TV operations under a temporary authority, which is permitted until 2024.
