During the election time, the Comelec issues a warning to anyone who violates the employment restriction.

MANILA – Violators of the restriction on hiring and moving staff during election periods were warned by the Commission on Elections (Comelec) on Wednesday.

After receiving complaints of violations of the ban, which is forbidden under Comelec Resolution No. 10742 and Section 261 of the Omnibus Election Code, the Comelec Law Department issued the reminder (OEC).

Officials of the National Commission on Muslim Filipinos (NCMF) — newly-appointed Secretary Atty. Guiling Mamondiong, his Chief of Staff Atty. Manggay Guro Jr., and NCMF Executive Director Tahir Lidasan Jr. — are accused of issuing orders that are allegedly in violation of Sec. 261(g) of the OEC, according to the report.

Mamondiong reportedly created the titles of Assistant Bureau Director, Assistant Regional Director, and Assistant Service Directors, according to the lawsuit.

It also referenced Comelec’s early termination of job order employees’ contracts.

Mamondiong reportedly appointed work order employees as well as replaced incumbent heads of offices and appoint their replacements, according to the report.

The allegation is currently being investigated by the Law Department to see if the NCMF broke any election laws.

The Comelec is charged by the Constitution with enforcing and administering all election-related rules and regulations.

All responsible officials of government agencies and instrumentalities have been urged to strictly adhere to election laws and regulations, according to the poll commission.

Election violations are punishable by imprisonment for a period of not less than one year but not more than six years, with no possibility of probation.
