According to the Commission on Elections (Comelec), extraordinary elections cannot be held before the House of Representatives declares a vacancy.

Following the appointment of Representative Rex Gatchalian as the new director of the Department of Social Welfare and Development, Comelec chairperson George Erwin Garcia is alluding to the congressional position of the first district of Valenzuela City (DSWD).

The head of the election agency said in a statement that “the House of Representatives must publish a Declaration of Vacancy to commence and cause the Commission on Elections (Comelec) to hold a special election; otherwise, the Congress can only select a caretaker.”

“Comelec requires a trigger paper to launch the Special Election preparation procedure. This is a call for a special election by Congress and a declaration of vacancy, he continued.

President Ferdinand R. Marcos, Jr. appointed Gatchalian on Tuesday to succeed Secretary Erwin Tulfo as director of the Department of Social Welfare and Development (DSWD), who twice failed to secure the approval of the Commission on Appointments (CA).

After former Rep. Crispin Remulla left the position when he was named Secretary of the Department of Justice, the case of the former mayor of Valenzuela City is comparable to the case of the 7th District of the province of Cavite.

The former position of Remulla has been declared vacant by the HOR, who set the special elections for February 25th through House Resolution No. 100 of July 27, 2022.
