Tax court rejects energy services provider’s request for a refund

Halliburton’s local subsidiary’s request for a PHP11 million tax refund was denied by the Court of Tax Appeals (CTA). Halliburton is a multinational petroleum exploration company.

The CTA unanimously rejected the Philippine branch of Halliburton Worldwide Ltd.’s request for a tax credit of merely PHP55,610 and upheld its earlier decision.

The company is one of Halliburton’s 70 affiliates globally and has a local license for oilfield services and related activities.

It submitted a request for a tax credit or refund in 2017 for PHP11.259 million in allegedly excessive and unused input value-added tax from interactions with renewable energy (RE) developers.

The CTA refused to grant a refund of the entire money after seeing that it had neglected to provide the necessary records of its dealings with RE developers.

The business asserted that the only documentation needed for a return under Republic Act 9513, often known as the Renewable Energy Act, is the Department of Energy Certificate of Registration.

It neglected to give its clients the necessary Board of Investments Certificate of Registration (BOI-COR).

“Neither can these papers be regarded as newly discovered evidence, nor was the evidence (BOI-COR) petitioner wishes to introduce withheld as a result of fraud, mistake, excusable neglect, accident, or mistake. As a result, such evidence does not support the grant of a new trial, the court ruled in its 16-page judgement, which was made public on Monday.
