TikTok Faces Potential EU Fine for Child Privacy Violation 📱💰
LONDON — TikTok, the popular Chinese-owned video-sharing platform, is in jeopardy of facing a substantial fine in the European Union due to its alleged breach of children’s privacy. The bloc’s data protection regulator, the European Data Protection Board (EDPB), has unequivocally determined that TikTok’s handling of children’s data warrants legal consequences.
The EDPB’s announcement follows TikTok’s legal challenges against a previous ruling in Ireland, the location of the company’s European headquarters. In response to the platform’s objections, the regulator has issued a definitive “dispute resolution decision,” signaling a firm stance.
The anticipated fine, likely amounting to millions of dollars, is expected to be formally issued within four weeks.
This verdict originates in an inquiry initiated in 2021 by the data protection commissioner in Ireland. The investigation scrutinized TikTok’s compliance with EU data protection regulations, particularly its practices concerning the data of individuals aged 13 to 17.
Aligned with the EU’s Digital Services Act, prominent online platforms, including TikTok, Google, and Facebook, are mandated to monitor and eliminate illicit content from their platforms actively. Additionally, they are prohibited from employing specific advertising techniques and must cooperate with authorities by sharing pertinent data.
TikTok’s encounter with regulatory penalties is not exclusive to the European Union. Previously, the UK’s data protection authority imposed a substantial fine of 12.7 million pounds (equivalent to over US$16 million) on TikTok. The fine was levied due to TikTok’s unauthorized data collection and handling of 1.4 million children under 13. These children had utilized the platform without obtaining the necessary parental consent.
The outcome of TikTok’s dispute with European regulators underscores the increasing emphasis on data privacy, particularly when it involves minors. As regulatory bodies uphold stringent data protection standards, platforms like TikTok are compelled to reevaluate their practices and ensure robust adherence to privacy regulations.
