
The House approves the mandatory registration of SIM cards.
The House of Representatives passed the resolution requiring the registration of Subscriber Identity Module (SIM) cards on third and final reading on Monday.
The chamber passed House Bill No. 5793, also known as the “SIM Card Registration Act,” with 181 affirmative votes, six negative votes, and no abstentions. The bill aims to assist law enforcement agencies in tracking down lawless criminals who use mobile phones with postpaid and prepaid SIM cards to engage in nefarious activities such as kidnapping for ransom and petty crimes like theft.
According to the bill, any public telecommunications enterprise (PTE) or direct sale of a SIM card must demand the end user to show a legitimate identification with a photo in order to verify the latter’s identity.
A control-numbered registration form issued by the PTE or direct seller must be completed and signed by the end-user.
It requires all PTEs to keep a subscriber SIM card registry and submit it to the Department of Information and Communications Technology (DICT) every six months.
It includes a confidentiality clause that prohibits the release of any subscriber information unless a competent court issues a subpoena or a lawful order, or a written request from a law enforcement agency in connection with an ongoing investigation, stating that the requested number was used in the commission of a crime.
It also requires existing prepaid SIM card phone subscribers to register.
