MANILA, Philippines — Following the implementation of Republic Act 11313, or the Safe Spaces Act, which forbids and penalizes numerous forms of gender-based sexual harassment, the Supreme Court (SC) has established rules for the development of gender-fair language and courtroom etiquette.

The guidelines were approved at the Supreme Court’s en banc session on Tuesday, according to a statement released on Wednesday.

The tribunal encourages the use of non-sexist language in official papers, correspondence, and issuances.

It highlighted the use of “person” instead of “man” and “humanity” instead of “mankind” as examples.

The use of male terminology for professions or jobs is discouraged, such as “chairperson” instead of “chairman” or “business owners” instead of “businessmen,” according to the statement.

The rules are part of the Committee on Gender Responsiveness in the Judiciary’s (CGRJ) initiatives, which are led by Associate Justice Amy Lazaro-Javier. They emphasize sensitivity to people of all sexual orientations, gender identities and expressions, and sex characteristics (SOGIESC).

Gender is described as “a set of socially ascribed features, norms, roles, attitudes, beliefs, and expectations determining the social conduct of men and women, and the relationships between them,” according to the Safe Spaces Act.

“Our courts are evidentiary courts, and their ability to take judicial notice of facts is limited.” Gender stereotypes, which are based on incorrect assumptions about the traits and roles of binary and non-binary genders, but undoubtedly impact the viewpoints of judges and litigants alike, cannot and should not be perpetuated by courts. This is reflected in the issues before the courts as well as the terminology used by the courts in adjudication,” the high court stated.
