Senatorial candidate wants clearer tax laws for social media influencers.

MANILA, Philippines — If he wins the May 9 election, a senate candidate pledged to press for clearer criteria in taxing vloggers (video bloggers) and other social media influencers.

Guillermo Eleazar, a candidate for the Partido Reporma, said in a statement Tuesday that news stories about the Bureau of Internal Revenue (BIR) pursuing vloggers and social media influencers have sowed anxiety and confusion among them, believing that they would be investigated and possibly imprisoned.

“Ang ilalaban natin ay magkaroon ng patas at malinaw na panuntutanan sa pagbabayad ng buwis ng mga social media influencers upang maiwasan natin ang kalituhan at pangamba,” he said.

The BIR issued Revenue Memorandum Circular (RMC) No. 97-2021 in August of last year, indicating that social media influencers are subject to Income Tax, Percentage Tax, or Value-Added Tax (VAT) under the National Internal Revenue Code (NIRC) of 1997, as amended, and other applicable legislation.

The circular was issued after the bureau received complaints that certain influencers were not paying taxes and that others were not even registered with the bureau.

Other than companies and partnerships, social media influencers are classed for tax purposes as “self-employed individuals or persons engaged in trade or business as single proprietors, and hence, their income is often recognized as business income,” according to the BIR.

To avoid being responsible for tax evasion and the civil penalty of 50% of the tax or the deficiency tax, social media influencers are urged to voluntarily and truthfully record their income and pay their corresponding taxes without waiting for a formal investigation by the BIR.
