Marcos enacts legislation delaying the December 2022 Barangay and SK elections.

Elections for the Sangguniang Kabataan (SK) and Barangays will not take place until December 2022 after a law was signed by President Ferdinand “Bongbong” Marcos Jr.

The Barangay and SK elections scheduled for this year on December 5 will take place on the final Monday in October 2023, thanks to Republic Act (RA) No. 11935, which Marcos signed on October 10.

The law states that synchronized elections for the Sangguniang Kabataan and barangays must occur on the final Monday of October 2023 and every three years.

According to RA 11935, the Barangay and SK officials’ terms of office will begin at noon on November 30 following their election.

“All existing Barangay and Sangguniang Kabataan officials must stay in office, unless sooner removed or suspended until their successors shall have been legally elected and qualified,” it continued.

Until the next barangay and SK elections, barangay and SK officials who are ex officio members of the Sangguniang Bayan, Sangguniang Panlungsod, or Sangguniang Panlalawigan will remain in their positions unless they are removed.

The Commission on Elections’ appropriations under the General Appropriations Act and/or supplemental appropriations will be used to pay for the amount required to implement RA 11935.

The remainder of this Act or any provisions not impacted thereby shall remain in force and effect if any section or provision of this Act is deemed unconstitutional. Reads RA 11935.

Every other law, act, presidential decree, executive order, issuance, presidential proclamation, rule, and regulation that is in conflict with or inapplicable to any provision of RA 11953 is repealed, changed, or modified by this.

On September 28, 2022, the Philippines’ House of Representatives and Senate passed RA 11935, a consolidation of House Bill No. 4673 and Senate Bill No. 1306.

Comelec Chairperson George Garcia stated last month that they might move the deadlines for submitting certificates of candidacy (COC) for the 2022 Barangay SK elections while they decide whether to accept postponement requests.

The initial date range for COC filing for the 2022 Barangay and SK elections was from October 6 to October 13.

Comelec will acquiesce.

Garcia said in a statement on Wednesday that Comelec will abide by the law delaying the BSKE.

“The Comelec must abide by the law, as I have previously stated. I have explained Comelec’s view on delaying the BSKE to the legislative and the President, and I hope that this position has been properly noted and taken into account,” he stated.

He said, “With this law, the legislative and executive agencies have determined that the Barangay and SK Elections (BSKE) shall be held in October 2023.

The polling organization, according to him, will release an updated schedule of events for the postponed elections “as soon as possible.”

He added that the best interests of all parties would be considered as we review our current and upcoming procurement contracts relating to the BSKE.

According to Garcia, the Comelec will have “an opportunity to further develop education and information programs for the benefit of our voters and future BSKE candidates” due to the postponement.

They would be able to resume voter registration during the one-year delay, he continued, “to ensure the wider participation of the citizenry.”

According to Garcia, aspirants, and voters alike will have more time “to prepare and think about their rights and duties, which they will exercise through their ballots and future positions.”
