Employers are reminded of holiday pay laws by DOLE-Bicol.
The Department of Labor and Employment (DOLE) 5 (Bicol) advised all private sector companies in the region on Friday to pay their employees properly for the Chinese New Year special non-working holiday on February 1.
In a social media post, the DOLE-5 stated, “If the employee did not work, the ‘no work, no pay’ concept shall apply unless there is a favorable corporate policy, practice, or collective bargaining agreement giving remuneration on a special day.”
The employee will be paid an additional 30% of his or her basic wage for the first eight hours of work on a special day, or basic wage x 130 percent + cost of living allowance (COLA), according to the article.
It further stated that if an employee worked more than eight hours on a given day (overtime labor), he or she would be paid an additional 30% of their hourly pay for that day (hourly rate of the basic daily wage x 130 percent x 130 percent x number of hours worked).
The DOLE-5 also stated that if an employee works on a special holiday that also happens to be a person’s rest day, he or she will be paid an additional 50% of his or her daily rate for the first eight hours of labor, or daily salary x 150 percent + COLA.
Furthermore, if an employee works more than eight hours (overtime work) on a special holiday that also happens to be the employee’s rest day, he or she will be paid an additional 30% of his or her hourly rate on that day, or the hourly rate of the basic daily wage x 150 percent x 130 percent x number of hours worked.
