To provide temporary licenses, nurse scarcity is not a national emergency.

The Professional Regulation Commission (PRC) stated on Monday that the lack of nurses could not be deemed a “crisis” to support a suggested idea to grant temporary licenses to nursing graduates who failed the board test.

The Medical Act of 1959, according to PRC Commissioner Jose Cueto Jr., is the only statute having a provision that might support Health Secretary Teodoro Herbosa’s proposal to issue temporary licenses to fill the 4,500 nursing posts in public hospitals around the country.

“In times of national catastrophes, it says for medical graduates who have not yet taken or passed the physician licensure exam. The Secretary of Health has been named specifically. However, typically, the Professional Regulation Commission is mandated to issue or grant special licenses to professionals, according to Cueto, who said during a CNN televised interview.

Cueto noted the 2013 Super Typhoon Yolanda in Tacloban City and the Covid-19 pandemic as two of the strongest examples of national emergencies.

According to him, public hearings are still taking place to update the Medical Act of 1959 to address contemporary, relevant issues.

Before this, the PRC asserted that neither the Philippine Nursing Act nor Republic Act 9173 contain any provisions allowing them or any other government body to grant temporary licenses to nursing graduates who failed the licensure exam.

According to Section 21 of the law, only foreign-licensed nurses who are well-known specialists, foreign-licensed nurses whose services are required for a medical mission, or foreign-licensed nurses employed by schools as exchange professors may receive a special or temporary permit.
